Introduction
These General Terms and Conditions ("Terms") serve as the End User Licence Agreement (EULA) for the Dayline AI app and govern your use of the health and fitness application ("App") provided by AllBlazing BV ("we," "our," or "us"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App. We comply with applicable law, including the EU General Data Protection Regulation (GDPR), the EU AI Act where applicable, and Dutch law.

Use of the App
- Personal Use: Dayline AI is provided for personal, non-commercial use only. You may not use the app for any commercial purpose without our express written consent.
- Age Requirement: The App is intended for users aged 18 and over. Users under 18 should not use the App without parental supervision and consent.
- Prohibited Uses: You may not: (a) reverse engineer, decompile, or disassemble the App; (b) use the App to violate any laws or regulations; (c) interfere with the App's operation or security; (d) use automated systems to access the App without permission.
- Account Responsibility: You are responsible for maintaining the security of your device and Apple ID. We are not liable for unauthorized access to your device or Apple account.
Health Data and Privacy
The App accesses health data from Apple Health, and with your permission may use Apple Weather (city-level location only) and Apple Calendar (long events only, no details). All such data is processed as described in our Privacy Policy. Health data is processed locally on your device and is never uploaded to our servers. App Features and Data Use
Dayline AI provides daily health insights ("Daylines"), pattern analysis, and AI-generated explanations based on your biometric data (e.g. HRV, resting heart rate, sleep, activity). Pro subscribers receive extended pattern context (e.g. up to 120 days), fuller AI insights, and optional integrations (Weather, Calendar) as described in the App and Privacy Policy. We process data only to provide these features. We are not responsible for the accuracy of data provided by Apple Health, Apple Weather, or Apple Calendar.

Dayline AI provides insights for informational purposes only. The App is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. The App is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of information provided by the App.
AI-Generated Content and EU AI Act Transparency:
- AI System: Insights are generated using artificial intelligence. The AI analyzes your health metrics and patterns (as permitted by your choices and our Privacy Policy) to create personalized, plain-language explanations. This is a limited-risk AI system under the EU AI Act; we provide transparency and do not use the App for prohibited purposes.
- No Guarantees: We do not guarantee the accuracy, completeness, or usefulness of AI-generated insights. Insights may contain errors, inaccuracies, or inappropriate content.
- Limitations: The AI system has limitations and may not always provide relevant or accurate insights. Insights are based on patterns and correlations, not medical expertise.
- Your Responsibility: You are responsible for evaluating the appropriateness of insights for your situation. Do not rely solely on AI-generated insights for health decisions. Human oversight (e.g. consulting a healthcare provider) is recommended where relevant.
Subscriptions and Right of Withdrawal (Dutch Consumer Law)
Pro subscriptions are managed through Apple's App Store. By purchasing a subscription, you enter into a contract with AllBlazing BV.
- Subscription Terms: Monthly and yearly Pro subscription options are available. The current price for each option is displayed in the App (paywall) and in the App Store at the time of purchase and may vary by region. You agree to the price and billing interval shown before you confirm purchase.
- Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel in Settings → [Your Name] → Subscriptions.
- Cancellation: You can cancel your subscription at any time through your Apple ID Account Settings. Cancellation takes effect at the end of the current billing period.
- Right of Withdrawal: Under Dutch consumer law (Distance Selling Act), you have 14 days to withdraw from a subscription contract without giving a reason, starting from the day you receive access. If you have started using the Pro features, you may be charged for the period of use.
- Refunds: Refund requests are handled by Apple according to their refund policy. For refunds outside Apple's policy, contact support@daylineai.com within 14 days of purchase.
- Price Changes: We reserve the right to change subscription prices. Existing subscribers will be notified 30 days in advance. Price changes apply to renewals only, not current subscription periods.
Limitation of Liability (Dutch Law)
To the maximum extent permitted by Dutch law (including the Dutch Civil Code), AllBlazing BV's liability is limited as follows:
- Exclusion: We exclude liability for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or health-related consequences.
- Maximum Liability: Our total liability for direct damages shall not exceed the amount you paid for the App (including subscriptions) in the twelve months preceding the claim, or €100, whichever is higher.
- Force Majeure: We are not liable for failures due to circumstances beyond our reasonable control, including but not limited to third-party service failures (e.g. our AI provider, Apple, Google), network issues, or device malfunctions.
- AI Content: We are not liable for errors, inaccuracies, or inappropriate content in AI-generated insights, as stated in the Medical Disclaimer section.
- Consumer Rights: Nothing in these Terms limits your rights as a consumer under mandatory Dutch consumer protection law.
Governing Law and Dispute Resolution
These Terms are governed by Dutch law (Nederlands recht), including the Dutch Civil Code (Burgerlijk Wetboek) and consumer protection regulations.
- Jurisdiction: Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the competent courts in The Netherlands, specifically the courts of The Hague (Rechtbank Den Haag) for business disputes, or your local court if you are a consumer.
- Consumer Disputes: If you are a consumer, you may also use the European Online Dispute Resolution platform (ec.europa.eu/consumers/odr) to resolve disputes.
- Applicable Law: Dutch law applies, including but not limited to: Dutch Civil Code, Consumer Rights Directive, Distance Selling Act, GDPR Implementation Act (UAVG).
- EU Consumer Protection: If you are an EU consumer, you also benefit from mandatory consumer protection laws of your country of residence that cannot be excluded by these Terms.
Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be notified through the App or via email. Your continued use of the App after such changes constitutes acceptance of the modified Terms.
